Maryland Citizen Action Network Statement on SCOTUS Same Sex Marriage Ruling

The Supreme Court’s ruling on same sex marriage is just the latest example of a court that has become unmoored from the Constitution. MD CAN would echo Justice Scalia who in his dissenting opinion said, “This is a naked judicial claim to legislative—indeed, super-legislative—power; a claim fundamentally at odds with our system of government.“

As with issues like the Obamacare individual mandate, the court increasingly demonstrates that it is more interested in spinning the Constitution to support a particular political point of view rather than interpreting it as the framers intended.

Citizens all deserve equal protection under the law regardless of sexual orientation but making law is the role of legislatures, not courts. An unaccountable and capricious judiciary is a threat to everyone’s liberty even if it rules in your favor in the short term. This SCOTUS decision usurps the the powers reserved to the states and the people by the 10th Amendment and will almost certainly lead to future violations of 1st Amendment rights to free expression and religious liberty.
